Creator Program Terms

These are the terms of the Beachday™ Creator Affiliate Program (version 1.0). Approved creators sign this agreement electronically before they receive their link.

BEACHDAY™ CREATOR AFFILIATE PROGRAM AGREEMENT

Agreement Version: 1.0

Effective Date: Date of electronic acceptance

This Creator Affiliate Program Agreement ("Agreement") is entered into between Woodstock Enterprises Inc., doing business as Beachday™ ("Beachday," "Company," "we," or "us"), and the participating individual or entity ("Creator," "Affiliate," or "you").

By electronically accepting this Agreement, the Creator agrees to the following terms.

1. Program Participation

The Beachday Creator Affiliate Program allows approved creators to promote the Beachday mobile application through social media, original content, and other authorized promotional channels.

Creators earn commissions for eligible, verified first-time application installs attributed to their unique referral links.

Participation does not establish an employment relationship, partnership, joint venture, or agency relationship between Beachday and the Creator.

Beachday reserves the right to approve, reject, suspend, or terminate participation in accordance with this Agreement.

2. Tracking & Attribution

All affiliate referral activity is tracked and attributed through Branch.io, Beachday's designated third-party attribution provider.

Each Creator receives a unique referral link.

The Creator acknowledges:

  • Commissions are calculated using eligible first-time application installs attributed through Branch.io.
  • Video views, impressions, likes, shares, and link clicks do not independently qualify for commissions.
  • Downloads not successfully attributed to the Creator's referral link may not qualify for compensation.
  • Attribution technology is subject to operating-system restrictions, privacy settings, technical limitations, and user behavior.
  • Beachday does not guarantee that every download influenced by a Creator's promotional content will be attributed to that Creator.
  • Existing-user app opens, reinstalls, duplicate installations, fraudulent activity, and other ineligible events do not qualify as new installs.

Branch.io attribution data, together with Beachday's internal validation records, serves as the primary basis for commission calculations.

3. Commission Rates

Creators receive the commission rate displayed in their dashboard or otherwise agreed upon in writing.

The initial standard program rate is $0.20 USD per eligible, verified first-time install, unless a different rate is displayed or agreed upon.

Beachday may modify commission rates prospectively with notice.

Changes will not retroactively reduce commissions already earned and validated under a previously applicable rate.

Earnings displayed in the dashboard may remain pending until validation is complete.

4. Monthly Commission Limit

Creators may earn up to $5,000 USD per calendar month through the Beachday Creator Affiliate Program.

Conditions:

  • The $5,000 monthly limit applies individually to each Creator.
  • Monthly earning limits reset on the first day of each calendar month at 00:00 UTC.
  • Once the Creator reaches $5,000 in eligible commissions, additional installs during the same month will not generate further commissions unless Beachday has previously approved a higher limit in writing.
  • Unused earning capacity does not roll over.
  • Beachday may adjust the limit prospectively with reasonable notice.
  • Commissions earned within the applicable limit remain payable under this Agreement.

The program may also operate under an overall affiliate commission budget. If Beachday establishes such a limit, the applicable amount and conditions must be clearly disclosed to participating creators before affecting their future earnings.

5. Verification & Internal Investigations

Beachday reserves the right to conduct reasonable internal investigations and audits to protect program integrity.

Investigations may include:

  • Reviewing Branch.io attribution records.
  • Identifying unusual referral patterns.
  • Investigating suspicious installations.
  • Examining potential bot activity, duplicate installs, or manipulated traffic.
  • Comparing Branch data with available application analytics.
  • Reviewing promotional content responsible for referral activity.
  • Requesting supporting documentation.

Beachday may temporarily withhold disputed commissions during a reasonable investigation.

Creators agree to cooperate in good faith with legitimate verification requests.

Valid, undisputed commissions will not be intentionally withheld without reasonable justification.

6. Content Verification

Beachday may request evidence of promotional activities.

Examples include:

  • Links to published videos.
  • Copies of original promotional videos.
  • Screenshots of social media content.
  • Available social media analytics.
  • Dates and platforms where content was published.
  • Supporting information relevant to disputed referrals.

Failure to cooperate with reasonable verification requests may result in delayed payment of disputed commissions or suspension.

Beachday will never require creators to disclose social media passwords or unrelated private information.

7. Prohibited Activity

The following activities are prohibited:

  • Generating artificial or fraudulent installs.
  • Using bots or device farms.
  • Manipulating attribution systems.
  • Repeatedly installing and uninstalling the application to generate commissions.
  • Misrepresenting Beachday or its features.
  • Using deceptive promotions.
  • Encouraging unauthorized incentives or fraudulent referrals.

Beachday may reject commissions attributable to fraudulent or prohibited activity and terminate accounts for serious violations, subject to applicable law.

8. Payments

Commissions are subject to verification before payment.

Beachday may apply a verification period of up to 30 days after the end of the applicable earning month.

Creators must provide accurate payment information and any reasonably required tax or identity documentation.

Verified, undisputed commissions will be paid according to the payment schedule displayed in the Creator Portal.

The portal must clearly communicate when commissions are pending, approved, paid, or disputed.

9. Disputes & Supporting Data

Creators may request a review of commissions they believe were incorrectly calculated.

Beachday will review disputes reasonably and in good faith.

Where relevant, Beachday may provide supporting Branch.io attribution reports, commission calculations, and internal verification records.

Information may be aggregated or redacted to comply with privacy laws, confidentiality requirements, and third-party contractual restrictions.

Branch.io and Beachday's internal validation data serve as the primary evidence for determining eligible commissions.

10. Creator Content & Brand Representation

Creators retain ownership of their original content.

Participation in the program does not automatically grant Beachday unrestricted rights to reuse their content commercially.

Separate permission may be requested for advertising or other commercial use.

Creators must accurately represent Beachday and disclose affiliate relationships according to applicable advertising laws and platform policies.

11. Termination

Either party may terminate participation in the program.

Beachday may suspend accounts for suspected fraud or material violations while conducting reasonable investigations.

Termination does not eliminate a Creator's right to receive valid, verified commissions earned before termination, subject to applicable payment conditions and monthly limits.

12. Electronic Acceptance

By electronically signing this Agreement, the Creator confirms that they:

  1. Have read and understood the agreement.
  2. Accept Branch.io as the designated attribution provider.
  3. Understand that only eligible, verified first-time installs qualify for commissions.
  4. Acknowledge the $5,000 monthly commission limit.
  5. Agree to reasonable verification and investigation procedures.
  6. Understand that supporting promotional content may be requested.
  7. Agree to follow applicable promotional and advertising requirements.
